(fiqh) the state or condition whereby any person may personally kill any other person with impunity because the latter has committed a crime or an irreligious act that invariably carries capital punishment in the canon laws of Islam whether as a general rule or as an incidental case. Under the Constitution of the Islamic Republic any person having killed any other person will be absolved if he can prove at trial that the person he killed deserved capital punishment according to the canon laws of Islam. This is quite different from the killing of a person in self-defense which is absolutely no defense in the shariat law (ie canon law) of Islam.
